General Conditions

Limitation of Liability;

1. Nothing in this Agreement shall affect the statutory rights of any consumer or exclude or restrict any liability for death or personal injury arising from the negligence or fraud of AOS Technology Ltd.

2. Subject to clause 1, you agree that AOS Technology Ltd shall not be liable either in contract, tort, negligence, statutory duty or otherwise, for any direct loss or damage (including loss or damage which is reasonably foreseeable or occurs naturally in the course of things) resulting from any acts, omissions, failures or delays occurring on or in relation to those parts of the Internet not AOS Technology Ltd s direct control including, without limitation, damage for loss of business, loss of sales, non payment of sums due, loss of profits, business interruption, loss of reputation, loss of business information, or any other pecuniary loss (even where AOS Technology Ltd has been advised of the possibility of such loss or damage).

3. The only liabilities that AOS Technology Ltd can exclude are those arising from the following.

Matters Beyond our Reasonable Control - AOS Technology Ltd shall not be held liable for any breach of this Agreement caused by circumstances out of its control including, but not limited to, Acts of God, fire, lightening, flood, or extremely severe weather, explosion, war, disorder, flood, industrial disputes (whether or not involving our employees), acts or omissions of Internet services providers or acts of local or central Government or other competent authorities.

Governing Law - Your use of this Site and any purchase by you on this Site of any products will be governed by English Law and will be deemed to have occurred in mainland United Kingdom.
Making A Purchase Making a purchase could not be easier. You can buy on-line, by mail, email, phone or fax. Just browse our store, and decide what you want. For on-line purchases, add any items that you wish to buy into the shopping cart. After you have finished your selection, click on 'Checkout' and you will be asked for a few details that we need to be able to complete the order. For purchasing by other methods, please contact our sales team by phone, fax, mail or email (sales@nightstaruk.com)

We accept a variety of credit card payments and, for off-line purchases, cheques drawn on a UK bank and UK postal orders. We do not accept cash payments. All payments must be made in Sterling

We will confirm the receipt of your order. This confirmation does not however, indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.

We will sell and you will purchase products subject to our terms and conditions set out below. The contract in respect of the products supplied by us to you comes into existence when your order has been accepted by us. For the avoidance of doubt, receipt of an order via our Site does not constitute acceptance of an order.


All prices are quoted in pounds Sterling and are inclusive of VAT unless otherwise specified.

All item prices are exclusive of delivery and packaging, unless otherwise stated.

Prices are correct at the time of order only and relate to internet purchases only. All orders for products are subject to availability and we reserve the right to refuse to supply any particular person.

We will retain the property in the products until full payment has been made by you and has been received by us.

Shipping And Handling We can only ship goods within the UK. If you are ordering for delivery outside of the UK, please contact the Customer Services Team. Shipping and handling charges will be added to your shopping cart at checkout and will be shown on your invoice. For small order quantities, we generally ship by Royal Mail First Class, or equivalent. For larger orders, we use the services of a carrier
Delivery Schedule We aim to despatch your goods on the day you place your order, although this may not be possible for orders received after 2.30pm. We guarantee that all orders will be received within 30 days. If we cannot deliver within 30 days you will be notified immediately to arrange another time for delivery, or if you would prefer, to cancel your order.
Back Orders If your item is not in stock, or if stock is not anticipated in time for us to meet our guaranteed delivery schedule, we will back order for you. You will always be contacted with the option to cancel your order if you would prefer not to wait.

Tax Charges FAll orders are subject to VAT at the rate ruling at the tax point date. All pricing on this site is INCLUSIVE of VAT unless indicated otherwise. We will issue you with a valid VAT invoice.
Credit Card Security For on-line purchases, your credit card and personal details will be safe as we use secure card processing managed by HSBC Bank. When you get to the payment stage of our checkout process you will transfer to the HSBC secure server to enter your card details and have payment confirmed. Transmission and processing are done using SSL encryption (Secure Socket Layer, the industry standard security protocol). Your credit card details are neither seen nor kept by us.

You can confirm the secure status of the HSBC payment server by observing from the small padlock that appears at the bottom of your browser screen when it is active and by seeing that the URL of the website in your browser has changed from "http://..." to "https://...". You can double-click the padlock icon to verify the security registration.. Depending on your browser settings, you may see a pop-up window informing you that your are entering or leaving a secure connection.
Some versions of browsers and some firewalls do not permit communication through secure servers.

If you are unable to connect to a secure server or if you prefer not to pay online, simply contact the Sales Team by email (sales@nightstaruk.com) , post, mail, phone or fax - See "About Us" above for contact details. For the sake of security, we STRONGLY advise you NOT to provide your credit card details to us except by telephone.
Guarantee We are completely confident that you will be delighted with your purchase of a NightStar torch, so confident in fact that all of our products come with a full 'no questions asked' guarantee for 30 days after the items are delivered to you.

If you or the person you bought the goods for are not completely satisfied with your Nightstar torch, then we will refund the cost of the goods in full. All you have to do is to contact our Customer Services Team (see below) and we will provide you with full instructions on how to return the goods to us and a Returns Material Authorisation (RMA). Once you have returned the goods to us, we will refund the cost of the goods in full. We regret that we cannot refund the costs of postage and packing, for both the original despatch of goods to you and in returning unwanted goods to us.

Goods MUST be received by us in a saleable condition, which means that they must not be damaged in any way and also that they must be in the original, unopened "blister" packaging

Our guarantee significantly exceeds your legal rights in this respect, which include:

- The UK Distance Selling Regulations provide you with a "cooling-off" period of 7 working days from the day after receipt of the goods. You can cancel your order for any reason during this time.
- Where goods are being returned, they must be returned within a reasonable period of the cancellation
- Where a refund is required for a cancelled order, the payment will be made within 30 days of the cancellation

You don't have to tell us why you are returning the goods for a refund, although clearly we would like to know if you don't mind telling us.

We cannot be held responsible for any third-party loss or consequential loss arising directly or indirectly from the use of our products.

If goods are in any way faulty we will replace them at our cost. We will also at our discretion, either collect the faulty goods from you or pay the cost of postage of any faulty goods returned to us and we will also pay the cost of postage of a replacement unit back to you. If you suspect that you have a faulty unit, please contact the Customer Services Team, who will discuss the problem with you and if necessary arrange for the return of your unit for inspection, using our RMA process.

We cannot accept responsibility for goods returned without an RMA, nor for goods which are received by us in a non-saleable condition

Please note that if we inspect the goods and find no fault, we will not refund the cost of the goods or your postage costs. We will make the goods available for collection from our offices for a period of 12 calendar months or, subject to the receipt of payment from you to cover the costs of postage and packing, will return them to you by mail.

This does not affect your statutory rights as a consumer.

AOS Technology Ltd does not disclose any customer information to any third parties. The information is used only for the purpose of processing your request and to communicate with you on any matters relating to the provision of the service in general. Information and statistics may also be used for the purpose of monitoring site usage. These statistics will not include any information that can be used to identify any individual.

Cookies are used on this shopping site to keep track of the contents of your shopping cart, to store delivery addresses if the address book is used and to store your details if you select the 'Remember Me' Option.
